Annick Demers is an Associate in the Financial Services Group. Her practice primarily focuses on regulatory compliance in the retail financial service industry in Quebec. She provides advice to Canadian and foreign financial institutions and financial service providers, including banks, trust companies, consumer finance companies, insurance companies, insurance agents and brokers, money transmission providers, payment card issuers, mortgage brokers and collection agencies on applicable regulations in Quebec. Annick assists these clients on various regulatory issues applicable to them, their products and services and distribution networks, and in the preparation, revision and negotiation of related commercial and consumer agreements. She assists such clients in their dealings with various Quebec regulators (such as the AMF, OPC and OQLF). Annick also provides general regulatory advice to clients of various industries including the construction, the hospitality and tourism industries.
Annick has become a resource person in the Firm for advising on all aspects of consumer protection, insurance, construction and French language requirements in Quebec.
In the area of consumer protection, in addition to assisting financial institutions and financial service providers, she provides advice to manufacturers and retailers on their legal obligations in Quebec (including those relating to advertising, warranties, commercial practices and collection of debts) and has extensive experience in preparing and reviewing standard form consumer contracts, consumer advertising and related documentation.
Annick's experience in insurance law consists of providing advice on various insurance regulatory matters, which includes advice on compliance with requirements applicable to the regime of insurance product distribution with and without representative and on the review of insurance product documentation.
In the area of construction law, Annick provides guidance to contractors, subcontractors and professionals on applicable construction regulatory requirements (including the determination of whether or not licensing is required). She also assists such participants in construction projects in the preparation and review of construction agreements. In recent years, she has participated in the internal reorganization of a large construction company.
In 2003 and 2004, Annick spent three months on a partial secondment to the legal and regulatory department of a major insurance company, where she provided legal advice to employees and executives of various departments. Her responsibilities included reviewing contests, promotions and advertisements, preparing and reviewing legal agreements, and managing various contractual and compliance issues.
Annick is a member of the Ontario Bar, the Association of Québec Women in Finance (AFFQ), the Montreal Association of Insurance Women (MAIW) and the Association des juristes d'expression française de l'Ontario (AJEFO). Annick is fluent in French and English.
