About Joshua

Josh practises corporate and commercial litigation and has appeared as lead counsel at all levels of court in British Columbia and at the Federal Court. He has also appeared at the Supreme Court of Canada.

He has experience in the defence of class actions, including matters with product liability, consumer protection, competition/antitrust, privacy, and regulatory compliance issues. He also has experience in domestic and international arbitrations, including disputes related to infrastructure projects, mining projects, and commercial transactions.

Josh has represented companies and individuals in a wide range of industries, including mining, construction, infrastructure, manufacturing, financial services, health services, and technology.

Some of Josh's recent experience includes acting as counsel to:

  • Competition class action proceedings related to car carrier services provided by a major international shipping company

  • Competition class action proceedings related to gasoline pricing in British Columbia provided by a major energy company

  • Two public mining companies in a trial involving a claim for a US$12-million finder's fee relating to the acquisition of a mine in Ecuador

  • Public companies in the metals manufacturing industry in a class action involving allegations of overcharges being passed on to automobile consumers

  • Financial services companies in a class action involving allegations of fees and expiry dates being imposed on financial products contrary to the B.C. Business Practices and Consumer Protection Act

  • Numerous publicly traded companies defending a variety of pharmaceutical, price-fixing, competition and privacy class proceedings

  • A venture capital company in court proceedings regarding the setting aside of a US$20-million arbitration award involving the financing of a clinical-stage pharmaceutical company

  • An internet-technology company in court proceedings regarding a contractual dispute involving the refinancing of outstanding loans and the issuance of warrants

  • A publicly traded mining company in an LCIA arbitration between Canadian, Bermudian and Czech entities involving a dispute over the sale of Mongolian mining assets

  • A major utility corporation in a domestic arbitration involving delay, disruption, and deficiencies claims in connection with the construction of significant energy infrastructure

  • An industrial services company in a domestic arbitration involving the acquisition of a business in a share transaction

  • A consulting firm in a domestic arbitration involving unpaid invoices and breaches of contract
