About Brady

Brady practises litigation and international arbitration, with specialist expertise in international trade law. Brady has represented clients at the Canadian International Trade Tribunal, the Federal Court of Canada, the ICC International Court of Arbitration, and all levels of court in British Columbia. His focus is on cross-border disputes, cross-border regulatory controversy, trade remedies, contractual disputes, public and administrative law, and complex international trade and sanctions issues.

Brady has a PhD in law from Trinity College, the University of Dublin, and is a former adjunct professor at the University of British Columbia. He currently sits on the Executive of the Canadian Bar Association International Law Section, and the Export Committee of the Canadian Association of Importers and Exporters.

International Trade, Sanctions and Controversy

Brady has provided counsel in relation to complex international trade issues including sanctions, import and export restrictions and controls, trade remedies, cross-border mergers and acquisitions, and cross-border disputes. Some of Brady's recent experience includes:

  • Lead counsel for subsidiaries of Capstone Infrastructure Corp. before the Canadian International Trade Tribunal in anti-dumping proceedings concerning imports of wind towers (Certain Wind Towers, NQ-2023-001)

  • Counsel to Flint Corp. and Flint Wear Technologies LP before the Canadian International Trade Tribunal in anti-dumping proceedings concerning imports of cold-rolled steel (Cold-Rolled Steel, RR-2023-006)

  • Counsel for the world's largest fast-food brand on Canadian sanctions law in relation to the divestment of its business in Russia

  • Counsel for various businesses regarding international forced and child labour compliance

  • Counsel to Wayfair LLC before the Canadian International Trade Tribunal in anti-dumping proceedings concerning imports of upholstered domestic furniture (Certain Upholstered Domestic Seating, NQ-2021-002)

  • Counsel to Canadian Pacific Railway Company before the Canadian International Trade Tribunal in anti-dumping proceedings concerning imports of transport container chassis (Certain Container Chassis, NQ-2021-005)

Corporate and Commercial Litigation and Dispute Resolution

Some of Brady’s recent representative commercial litigation matters include:

  • Arbitration counsel to an owner in defending a C$1.25-billion ICC arbitration claim regarding construction of energy infrastructure

  • Counsel to Bausch Health Companies Inc. and Valeant Canada LP in a putative class action brought on behalf of all Canadian federal and provincial governments relating to the marketing and sale of medication containing opioids (The Province of British Columbia v. Apotex Inc., et al.)

  • Counsel to Mowi Canada West Inc. in a judicial review before the Federal Court of the federal government's decision to prohibit aquaculture licence renewals in the Discovery Islands region of British Columbia (Mowi Canada West Inc. et al. v. Minister of Fisheries, Oceans and the Canadian Coast Guard)

  • Arbitration counsel to a Canadian aviation company in an ICC arbitration claim relating to the export of a military aircraft to a foreign buyer

  • Arbitration counsel to a federation of municipalities in an arbitration dispute regarding the operation of certain public infrastructure

  • Counsel to a multinational industrial manufacturing corporation in a class action involving statutory causes of action, tort claims, and conflicts of law

  • Counsel to a leading Canadian mental health charity with respect to contested intellectual property

Professional Activities

Brady is an associate member of the Chartered Institute of Arbitrators. Brady also serves on the Executive of the Canadian Bar Association International Law Section, as well as the Export Committee of the Canadian Association of Importers and Exporters. Brady is also a member of the Vancouver Bar Association, Young Canadian Arbitration Practitioners, the Centre for European Legal Studies, and the Irish Society for European Law.

Brady frequently publishes in his areas of expertise. He is the author of The Constitutional Boundaries of European Fiscal Federalism (Cambridge University Press, 2022) and has written articles on international topics for leading academic journals, including the European Law Review and the European Investment Law and Arbitration Review.

Brady is a former adjunct professor at the Peter A. Allard School of Law at the University of British Columbia (UBC). He has also been a guest lecturer in international trade law at UBC, and a moot coach for UBC's and UVic's Willem C. Vis International Commercial Arbitration Moot teams.
