About Ariel

Ariel practises litigation and dispute resolution with an emphasis on complex commercial and infrastructure arbitrations. Her extensive experience includes advocating for clients in contractual and construction disputes in the energy, mining and technology sectors. Ariel has appeared in the superior courts of British Columbia and Yukon, the British Columbia Court of Appeal, and the Supreme Court of Canada.

Ariel works frequently with engineers and subject-matter experts across North America to evaluate and advance her clients' unique strategic interests. She is a regional director for the Society of Construction Law (BC Region), and a member of the Vancouver International Arbitration Centre's Rules Committee.

Ariel's litigation and arbitration experience includes:

  • Counsel for an owner in defending a C$1.1-billion ICC arbitration claim regarding construction of energy infrastructure

  • Counsel for an owner in respect of a C$1.2-billion ICC arbitration claim regarding pipeline construction

  • Counsel for the design-builder of municipal infrastructure in a C$25-million ICC arbitration

  • Counsel for a contractor in a C$100-million arbitration regarding the construction of a high voltage transmission line

  • Counsel to a major utility corporation in a C$350-million arbitration involving delay and disruption claims in connection with the construction of significant energy infrastructure

  • Counsel in an international arbitration regarding a mining joint venture dispute

  • Counsel in arbitrations involving complex contractual claims relating to accounting, financial controls, and project management

  • Appellate counsel in appeals of lower court decisions, including as lead counsel in an appeal regarding the application of the Partition and Property Act

  • Counsel for a major North American building supplier, defending a claim that the materials supplied to a BC mine were defective

  • Counsel in proceedings involving freezing orders and injunctions, including defeating an application for an injunction which would have prohibited Lyft from operating in British Columbia

  • Counsel in commercial litigation regarding contractual risk allocation and apportionment of liability in connection with contaminated sites

  • Counsel in judicial review and administrative proceedings, including a multi-party Environmental Appeal Board proceeding involving significant jurisdictional and regulatory issues

  • Defence counsel in a major class action relating to the marketing and sale of pharmaceutical products in Canada
